OLROE - Roe: The Rise and Fall of a Constitutional Doctrine
Course Description
This course will analyze one of the most controversial episodes in U.S. constitutional history – the jurisprudence surrounding Roe v. Wade. We will review the precursor cases that provided the foundation for Roe; the reasoning of Roe itself; how Roe evolved in order to address inherent contradictions and ferocious political pressures; and finally, the demise of Roe in the Dobb decision. Roe is one of the most instructive examples of the interaction between politics, morality, and law under the American constitutional system.Notes
